Decoding Corrupt Business Influence

Under Indiana Code IC 35-45-6-2, corrupt business influence is outlined as a Level 5 felony. But what does this entail?

Defined Acts:

  1. Receiving Proceeds from Racketeering: If an individual knowingly or intentionally receives proceeds from a pattern of racketeering activity and uses or invests those proceeds to acquire an interest in property or to establish or operate an enterprise, they can be charged with corrupt business influence.

  2. Acquiring or Maintaining Control: Engaging in a pattern of racketeering activity to acquire or maintain, directly or indirectly, an interest in or control of property or an enterprise is a punishable offense under this law.

  3. Conducting Activities in a Racketeering Enterprise: Being employed by or associated with an enterprise and knowingly or intentionally participating in its activities through a pattern of racketeering activity falls within the scope of corrupt business influence.
