  3. Felony Charges: If the accused has a prior unrelated conviction for public indecency, the offense becomes a Level 6 felony, carrying more severe penalties.

  4. Definition of Nudity: The law defines nudity as the exposure of the human male or female genitals, pubic area, or buttocks with less than a fully opaque covering. Additionally, the female breast is considered nude when less than fully covered, excluding any part of the nipple. Male genitals in a discernibly turgid state are also included in this definition.

  5. Indecent Exposure: Indecent exposure, a Class C misdemeanor, is applicable when the aforementioned acts occur in a place other than a public space but are visible to persons other than invitees and occupants of that place.
